Tutu’s Afrimart Terms & Conditions

Welcome to Tutu’s Afrimart (“we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your use of www.tutusafrimart.ca (the “Site”) and any purchases or services provided through the Site (collectively, the “Services”).

By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.

2) Eligibility

By using our Services, you confirm that you are at least the age of majority in your province/territory, or that you are using the Site under the supervision of a parent or guardian.


3) Products & information accuracy

We sell food items including dry goods and frozen/perishable items.

  • We do our best to display accurate product descriptions, photos, weights, and pricing.
  • Minor variations may occur due to sourcing, packaging, seasonal availability, and batch differences.
  • Product photos are for illustration and may differ slightly from the actual item.

We reserve the right to correct errors (including pricing or product information) and to cancel or refuse orders affected by such errors.


4) Food safety & natural product variation

By purchasing from us, you understand and accept that:

  • Food products may have natural variations (for example: palm oil thickness or colour, dried food colour, size differences, etc.).
  • You are responsible for reading product details and selecting items suitable for your needs.
  • For frozen/perishable items, proper storage upon receipt is required to maintain quality.

5) Orders, availability & substitutions

All orders are subject to acceptance and product availability.

If an item is out of stock or unavailable, we may:

  • contact you to choose an alternative, or
  • remove the item and refund that portion, or
  • cancel the order (if needed)

6) Pricing, currency & payment

  • All prices are listed in Canadian Dollars (CAD) unless stated otherwise.
  • Taxes and shipping fees (if applicable) are calculated at checkout.
  • Payment must be completed before an order is processed.

We reserve the right to change prices at any time without notice, but changes will not affect orders already paid for and confirmed.


7) Shipping & delivery

Shipping and delivery details (timelines, same-day delivery areas, frozen shipping days, etc.) are outlined in our Shipping Policy, which forms part of these Terms.

Key reminders (summary):

  • Same-day delivery (KWC: Kitchener/Waterloo/Cambridge): Orders placed before 12pm (Mon–Sat) may qualify for same-day delivery. Orders after 12pm will be delivered the next day.
  • Frozen items: Please select fast delivery options at checkout to keep items frozen/safe.
  • Out-of-province frozen shipping: Frozen goods ship Mondays–Wednesdays. Orders placed Thursday–Sunday ship on Monday.

Delivery timelines shown at checkout are estimates and may be affected by weather, carrier delays, or remote locations.


8) Pickup (by appointment only)

Pickup is available by appointment only in Cambridge, Ontario at an agreed location.

  • You will receive a text/email once your order is ready and a pickup time is confirmed.
  • Please wait for confirmation before coming for pickup.
  • Risk of loss transfers to you once the order is picked up.

9) No returns (food items) & refunds for issues

Due to the nature of food products, all sales are final and we do not accept returns or exchanges.

If there is an issue with your order (wrong item, missing item, or damage on arrival), please contact us within 24 hours of delivery/pickup with:

  • your order number
  • clear photos (if damaged)
  • a brief explanation

If approved, we may provide a replacement, store credit, or refund, depending on the situation and product type. Full details are in our Refund Policy, which forms part of these Terms.


10) Customer responsibilities

You agree to:

  • provide accurate delivery/pickup and contact information
  • choose appropriate shipping options for frozen/perishable items
  • store food products properly upon receipt
  • use products safely and in accordance with any storage/cooking guidance

We are not responsible for quality issues caused by delayed refrigeration/freezing after delivery, missed delivery, unattended deliveries, or incorrect storage.


11) Prohibited use

You agree not to misuse the Site or Services, including by:

  • attempting to gain unauthorized access to the Site or systems
  • interfering with Site security or performance
  • using the Site for fraudulent activities or illegal purposes

We may suspend or refuse service if we suspect misuse, fraud, or abuse.


12) Intellectual property

All content on this Site (logos, product photos, text, designs, branding) belongs to Tutu’s Afrimart or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or use our content without written permission.


13) Limitation of liability

To the fullest extent permitted by law, Tutu’s Afrimart is not responsible for issues arising from:

  • incorrect shipping addresses provided by customers
  • missed delivery attempts or failed delivery due to customer unavailability
  • improper storage or handling after delivery/pickup
  • carrier delays outside of our control
  • natural product variations (e.g., palm oil thickness, dried food colour)

Our total liability for any claim will not exceed the amount paid for the order giving rise to the claim, where permitted by law.


14) Right to refuse service / order limits

We reserve the right to:

  • limit quantities
  • cancel orders suspected of resale, policy abuse, or fraudulent intent
  • refuse service at our discretion where permitted by law

15) Changes to these Terms

We may update these Terms from time to time. The updated Terms will be posted on the Site with a new “Last updated” date. Continued use of the Services means you accept the updated Terms.


16) Privacy

Your personal information is handled according to our Privacy Policy, which forms part of these Terms.
